Terms of use

Who we are

ElevateMode is provided by Elevate Corporate Training Pty Ltd (ABN 86 631 877 177), of 8/60 Carrington Street, Sydney NSW 2000 ("Elevate", "we", "us"). These terms apply to every organisation that uses ElevateMode (a "Customer") and to every person who signs in ("you", a "Member"). By creating a workspace, accepting an invitation or using the service, you agree to them.

What ElevateMode is

ElevateMode is a practice tool for workplace conversations: short video scenarios you respond to, scored and coached by an AI coach called Mode. It supports leadership development; it is not professional, legal, HR or medical advice, and decisions about real people and real situations remain yours.

Accounts and access

Access is by invitation from your organisation's admin or by creating a workspace. Keep your password to yourself and tell us if you think your account has been used without your permission. Your organisation's admins can add people, change roles and see the team's progress and practice responses — that is what the product is for.

Acceptable use

Use ElevateMode for its purpose. Don't try to get around access controls, scrape or copy the scenarios and clips, put anyone else's private information into a practice response, or use the service to harass or discriminate. We may suspend access that breaks these terms.

Your data and privacy

We handle personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Your workspace data is stored in Sydney, Australia, and each organisation's data is kept separate from every other organisation's. Practice responses are processed by third-party providers to make the product work — Anthropic (United States) scores written attempts and runs the coach, and ElevenLabs (United States) transcribes voice responses — and only the content needed for that step is sent; those providers do not use it to train their models. We use privacy-conscious analytics (Microsoft Clarity) with typed content masked. Practice data is retained for as long as your organisation uses the service and for a reasonable period after; ask us at info@elevatecorporatetraining.com.au about access, correction or deletion.

Improving the coach with your practice

With your consent, we may use your practice responses, scores and coach feedback to train and improve Elevate's own AI coach. You choose this when you accept your invitation and can change it at any time in Settings. Opting out stops your data being used for training from that point; it doesn't remove anything from your own history or your organisation's records. Training data is used by Elevate only and is never sold.

Content and intellectual property

The scenarios, videos, rubrics, coach and everything else that makes up ElevateMode belong to Elevate or its licensors. Your practice responses belong to you and your organisation; you give us the licence we need to store, process, score and (if you've consented) train on them. You can't copy, resell or share the content outside your organisation.

Fees

Fees, if any, are as agreed in writing with your organisation. Prices are in Australian dollars and exclude GST unless stated. Where the service is provided free (for example a pilot or beta), we may change or end that arrangement on notice.

Availability and changes

We aim to keep ElevateMode available and improving, and we ship changes often. We don't promise a particular level of uptime, and there may be interruptions while we make changes or fix things. We'll give reasonable notice of changes that materially reduce what the service does.

Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that can't be excluded. Otherwise, to the extent the law allows, our liability for anything arising out of the service is limited to re-supplying the service or the fees your organisation paid in the twelve months before the claim (or AUD 100 if none), and we aren't liable for indirect or consequential loss. You use the coach's feedback at your own judgement.

Ending

Your organisation can end its use of ElevateMode at any time by telling us. We can end or suspend access for a serious or repeated breach of these terms, or if we stop providing the service, on reasonable notice. What happens to your organisation's data at the end is set out in the privacy section above and in your organisation's agreement with us.

General

These terms are governed by the laws of New South Wales, Australia, and the courts there. If part of these terms can't be enforced, the rest still applies. We may update these terms; the current version is always at this page and we'll flag material changes in the app.
